Privacy notice
JacksBrad Property (“we”) is an estate agent in England and Wales. This notice explains what personal data we hold about people selling and buying homes through us (and others we deal with in a sale, such as solicitors and brokers), why, how long for, and your rights. We are the controller of this data. Contact us at hello@jacksbrad.com.
What we collect
- Sellers: your name and contact details, the property's details and photos, your terms of business with us, viewing arrangements, offers and our notes of conversations with you, and what you tell us about your onward move.
- Buyers: your name and contact details, what you're looking for, your buying position (for example a mortgage agreement in principle, proof of funds or a property to sell), viewings, feedback and offers.
- Identity checks: the law requires us to check who sellers and buyers are and where a buyer's money comes from. We keep copies of the documents you give us for this and a record of the checks.
- Others in a sale: work contact details for solicitors, mortgage brokers and surveyors.
- When you use our website or account: a record of your sign-ins and the forms you send (including the date, and the wording of anything you agreed to), and technical details needed to keep the service secure.
How we use it, and why we're allowed to
- Selling your home, or helping you buy one: marketing, viewings, passing on offers, and progressing the sale to completion. Our legal basis is the contract with you (sellers) or taking steps you've asked for, and our legitimate interests in running the sale.
- Telling sellers about offers: the law requires us to tell sellers about every offer, in writing. We share a buyer's offer and their buying position with the seller, but not their contact details.
- Emails about other homes: property alerts you set up, and other news only if you've opted in. You can stop them at any time. Our legal basis is your consent.
- Legal duties: anti-money laundering checks and records (the Money Laundering Regulations 2017), estate agency law, our redress scheme, tax and accounting records.
How we use AI
To save time, an AI assistant (Claude, provided by Anthropic) may help draft property descriptions and summarise viewing feedback. A person at JacksBrad checks everything before it's used or sent, and the AI never makes decisions about you: people do. Anthropic processes this data on our behalf under a data processing agreement and doesn't use it to train its models.
Who we share it with
- The other side of your sale, as needed: sellers see offers and feedback (not buyers' contact details); both sides' solicitors receive the memorandum of sale.
- Service providers who help us run the business, under contracts that require them to protect it: our hosting, Google (Workspace email and calendar) and Anthropic (the AI assistant).
- Our redress scheme if you complain to it, and anyone we're required to by law (for example HMRC, or the authorities about suspected money laundering).
We never sell personal data. Some providers may process data outside the UK; where they do, it's protected by UK-approved safeguards such as the International Data Transfer Addendum.
How long we keep it
We keep a buyer's details for 24 months after we were last in real contact with them (a viewing, an offer, an email exchange), then remove them, after asking whether you'd like us to keep them. Records of sales, identity checks and money laundering checks are kept for five years after the sale ends, as the law requires, and accounting records for six years.
Your rights
You can ask us for a copy of your data, to correct it, to delete it, to stop or restrict using it, or to send it to you in a portable format. You can withdraw consent to marketing emails at any time. Email hello@jacksbrad.com; we'll reply within one month. If you have an account, you can also do much of this yourself. Some records (such as identity checks) we must keep even if you ask us to delete them. If you're unhappy with how we've handled your data, you can complain to the Information Commissioner's Office at ico.org.uk.
Changes
We'll update this notice when how we use data changes, and change the version above. When you agree to something on our forms, we record which version you saw.
